Intensive Workshop for the Training of Mediators Monday, 16th February to Friday, 20th February, 2009 at Walchand Hirachand Hall (4th Floor)
We are pleased to inform you that an Intensive Workshop for the training of Mediators is being organized jointly by the IMC Court of Arbitration & Conciliation Committee and the Law: Review, Reforms and Rationalisation Committee of IMC in association with Prachi (Professional Resolutionary, Adjudicatory & Conflict Handling Initiatives) from Monday , 16th February, 2009 to Friday, 20th February, 2009 at the Walchand Hirachand Hall (4th Floor). The details are as under:
Mediation offers the opportunity to resolve disputes in a speedy, economical and confidential manner. Mediation is a voluntary process whereby the Mediator, a trained neutral person, facilitates a dialogue between disputing parties in course of which he assists them in understanding their substantive interests and underlying concerns, in exploring and generating options for satisfying the same and in arriving at a mutually acceptable agreement for resolution of their dispute.
In India, with the enactment of the Arbitration and Conciliation Act, 1996 and the introduction of new Section 89 in the Code of Civil Procedure, 1908, Parliament has given recognition to alternative methods of dispute resolution. Mediation, as a dispute resolution mechanism, has many advantages. However, a successful Mediation, leading to a wholesome resolution, is not as easy as is usually presumed.
The success of Mediation proceedings depend upon the ability and skill of the Mediator to engage the parties in the process in a collaborative manner so as to create an environment for a meaningful dialogue which is focused on addressing the concerns and meeting the the interests of the disputing parties. However, rarely are the disputants in a conciliatory frame of mind. And their legal representatives too are usually trained and geared only towards an adversarial approach. Hence the need of training for individuals seeking to be Mediators. This Workshop is designed to give a step-by-step understanding, coupled with stage-wise training (through demonstrations & role-plays), to aspiring Mediators and others dealing with conflicts/disputes, in the fundamentals of the mediation process and the role of the Mediator.
The Workshop will be conducted under the joint-aegis of the IMC and Prachi by Mr. Braja Bihari Das (Brian Bloch), International Trainer of Mediators and Director, ISKCONResolve and Mr. Prathamesh D Popat, Counsel, Arbitrator and Mediator, Founder: Prachi Mediation.
Born in New York and settled in Mathura, Mr. Braja Bihari Das is a graduate from University of Michigan and has done his M.A. from Eastern Mennonite University, USA in Conflict Transformation. He has also done fourty hours Mediation course and other training courses on Leadership and Management, Communications.
He has mediated scores of disputes in various cities in India such as Delhi, Kolkatta, Allahabad, Varanasi, Bangalore, Hyderabad, Mumbai, Pune, Lucknow, Baroda etc and has also done mediations in other countries including China, South Africa, Mauritius, UK, Belgium, Holland, Germany, France, US, Canada, Fiji, New Zealand, Australia, Mexico, Italy, Brazil, Croatia, and Ireland.
He has also facilitated hundreds of meetings and over a dozen strategic planning exercises and also handled over 800 ombud's cases as Ombudsman. He has considerable experience in teaching not only in India but also in many other countries.
In India, working in conjunction with the Supreme Court and various High Courts, he has trained Judges and lawyers in AP, MP, UP, Maharastra, Gujarat, Orissa, Jharakand, Delhi, Punjab, and Haryana.
Mr. Prathamesh D Popat is a Counsel, Arbitrator and Mediator and is the Founder of Prachi. He started his law practice as a Counsel in the Chamber of Aspi P Chinoy at the Bombay High Court. After having taken his Accredition as a Mediator from LEADR, a peak Dispute Resolution organization in Australia, he continues to expand his understanding of the field of dispute resolution by taking further, advanced trainings from several leading institutes across the globe.
He is an empanelled Mediator at the Bombay High Court and has Mediated several disputes referred to him directly as also by various courts in Mumbai. He regularly trains professionals, students and others in the art of Mediation.
The Training Workshop will be an interactive one, comprising of lectures, exercises, demonstrations, role-plays and coaching. The number of participants will be limited to no more than 21, preferably in multiples of three, on a first-come-first-served basis, so as to facilitate a one-to-one interaction, especially during crucial parts of the training.
